I don't think it's time to hit the panic button yet. Let's see who Bush Jr. appoints. There's a good chance that he'll realize that any political capital he spends now on the Supreme Court is political capital he won't have to deal with Social Security, Tax Reform, Foreign Policy, or anything else he wanted to do with his second term.
The question I'm wondering about is if both sides will be willing to compromise IF a moderate conservative is appointed.
